These SMS Terms and Conditions (the “SMS Terms”) govern the text messaging program offered by Ear, Nose, Throat & Allergy Center of Austin, also doing business as ENT & Allergy Center of Austin (“ENT & Allergy Center of Austin,” “we,” “us,” or “our”). By opting in to the program, you agree to these SMS Terms and acknowledge our Privacy Policy.
1. Program Name and Purpose
The program is called the ENT & Allergy Center of Austin Text Messaging Program. Through this program, we may send appointment reminders, scheduling messages, office updates, patient-service information, educational health information, surveys, special offers, and other marketing or promotional communications related to our practice and services.
Text messages are not a substitute for professional medical advice, diagnosis, treatment, or emergency care. Do not use text messaging to communicate urgent medical concerns or sensitive health information. Call 911 in an emergency.
2. Program Number
Messages will be sent from (512) 768-4892. The number used by the program may change. If it changes, we will notify subscribers as appropriate. Messages sent from any other number may not be part of this program.
3. How to Opt In
You may enroll by providing your mobile telephone number through a designated website form, appointment or registration form, or another opt-in method specifically offered by ENT & Allergy Center of Austin. When enrolling through a form, you must affirmatively select the SMS consent checkbox or otherwise provide the requested electronic signature. The consent checkbox should not be preselected.
If we advertise a text-to-join keyword, you may also enroll by texting the advertised keyword to the program number and following the instructions in the confirmation message.
You represent that you are the subscriber or customary user of the mobile number provided and that you are authorized to consent to receive text messages at that number. Please do not provide a telephone number that belongs to someone else.
4. Consent to Automated Promotional Messages
By opting in, you provide your prior express written consent to receive recurring automated text messages from or on behalf of ENT & Allergy Center of Austin at the mobile number you provide. These messages may include advertising or promotional content and may be sent using an automated telephone dialing system or other automated technology.
Your consent is specific to ENT & Allergy Center of Austin. Consent to receive automated promotional text messages is not a condition of purchasing any goods or services or receiving medical care.
5. Message Frequency
Message frequency may vary based on your interactions with us, scheduled appointments, and the communications you have requested. You may receive recurring messages.
6. Message and Data Rates
Message and data rates may apply. Your wireless carrier’s message, data, and other charges are your responsibility. Contact your carrier for information about your mobile plan.
7. How to Opt Out
You may withdraw your consent and stop receiving program messages at any time by replying STOP, CANCEL, QUIT, UNSUBSCRIBE, or END to a message from us. You may also contact us using the information in Section 16.
After submitting an opt-out request, you may receive one final message confirming that you have been unsubscribed. No additional program messages will be sent unless you later provide consent and opt in again. Your opt-out request applies to the text messaging program associated with the number to which you sent the request; you may need to opt out separately from another program or sending number.
We will honor legally sufficient revocation requests made through other reasonable methods as required by applicable law. Please allow a reasonable period for us to identify and process requests made outside the automated keyword process.

Please do not include protected health information, sensitive medical details, or emergency requests in a HELP message or ordinary email.
9. Supported Wireless Carriers
The program is intended to work with major participating U.S. wireless carriers, including AT&T, T-Mobile, Verizon, U.S. Cellular, Boost Mobile, Cricket Wireless, Metro by T-Mobile, Google Fi Wireless, Spectrum Mobile, and Xfinity Mobile, as well as other participating regional carriers and mobile virtual network operators.
Carrier participation and program availability may change without notice. Not all mobile devices, plans, or carriers support every type of SMS or MMS message.
Wireless carriers are not responsible for delayed or undelivered messages.
10. Delivery and Availability
Message delivery is subject to effective transmission by your wireless carrier and network operator. Delivery is not guaranteed. Messages may be delayed, blocked, or not delivered because of carrier filtering, network availability, device settings, an inactive or reassigned telephone number, or circumstances outside our control.
ENT & Allergy Center of Austin and its service providers are not liable for delayed, failed, misdirected, or undelivered messages to the fullest extent permitted by law. Nothing in these SMS Terms limits rights or remedies that cannot legally be waived.
11. Mobile Number Changes and Reassignment
If you stop using or change the mobile number enrolled in the program, you agree to opt out before discontinuing use of that number and to notify us promptly. This helps prevent messages from being sent to a person who later receives your former number.
12. Privacy and Protection of Consumer Information
We respect your privacy and use reasonable administrative, technical, and physical safeguards designed to protect the personal information associated with the program. However, no electronic transmission or storage method is completely secure, and we cannot guarantee absolute security.
We do not sell or share mobile telephone numbers, SMS opt-in information, or SMS consent records with third parties or affiliates for their own marketing or promotional purposes. We may disclose information to vendors acting on our behalf when necessary to administer and deliver the messaging program, comply with law, protect rights or safety, or complete a transaction or organizational change. Service providers may use the information only to perform services for us and as permitted by law.

13. Healthcare Communications and Security
SMS and MMS may not be encrypted and could be viewed by anyone with access to your device, mobile account, or message history. By enrolling, you acknowledge these risks. We will use text messaging only as permitted by applicable law and our privacy practices, but you should not use ordinary text messages to send diagnoses, test results, detailed symptoms, insurance information, payment-card information, or other sensitive information.
Text messages are not monitored continuously. They should not be used for urgent questions, medical emergencies, medication emergencies, or requests requiring an immediate response. Call our office for time-sensitive matters and call 911 in an emergency.
14. Age-Restricted and Controlled Content
The program is not intended to advertise adult content, the unlawful use of controlled substances, or other prohibited content. We do not promote the misuse or abuse of prescription drugs or controlled substances through this program.
If we later offer a separate campaign involving legally age-restricted content, enrollment may require age verification before messages are sent. Any such campaign will be subject to additional disclosures, applicable laws, and carrier requirements.
15. Changes, Suspension, and Termination
We may modify these SMS Terms or change, suspend, or terminate all or part of the program at any time. Updated terms will be posted on this page with a revised effective date. Changes apply prospectively unless otherwise stated or required by law. Your continued participation after updated terms become effective constitutes acceptance of those changes, to the extent permitted by law.

17. Governing Law
These SMS Terms are governed by applicable federal law and the laws of the State of Texas, without regard to conflict-of-law principles. Any provision found unenforceable will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.
